Hi all, My SW doesn't know the answer to this question and HMRC couldn't advise either.
I bought home baby bear 2 weeks ago and have finally got around to looking through the heap of paperwork. I get child tax credits for my first AS and will be able to claim for BabyBear but don't know when or how. I rang the helpline and they said they need his name as on original birth certificate. I didn't feel comfortable with giving that and SW says I shouldn't have to.
The advice on HMRC website says they need to see birth certificate (specifically in relation to adopted children), I don't have one and won't get one.
How do I claim please and can I do it before AO is passed as you can child benefit??
Thanks, MommaBear x

Can SW not get you a letter from legal dept or court explaining why you don't have a birth certificate, possibly also ask to speak to a senior manager not just the helpline person, must be a way round it

I'm with Serrakunda, ask to speak to someone in authority, they must have encountered this before. Am a bit perplexed when you say you won't get a birth certificate, surely everyone gets one, even if you have to wait a while?

The child's birth certificate shows details of birth parents so no, I won't get that. Never did for my first adopted son.
You get an adoption certificate which over rides the birth certificate.
The LA have a copy of birth certificate for when child is older but as far as I have always been told, adopters don't get them.
It takes ages for adoption certificate to come through so won't have that for months.
I will try ringing again today.
Thanks.

I though when you said you didn't have to original birth certificate it was something to do with being so young.
I have Simba's original birth certificate, I thought it was usual practice. I claimed for tax credits about six months before I had the adoption order and new birth certificate.
If LA won't give it to you they'll have to provide you with some suitable evidence

Oh right, maybe each LA is different then.
I spoke to a much more helpful chap from HMRC today who has put the claim in.
They will write to me if they need more info.
The LA have given me a letter for child benifit in place of a birth certificate.

I got three copies of the original birth certificate on the day Starlet moved in. One for child benefit, one for her passport and one for the AO. Like Serrakunda I assumed this was standard practice!
Can't answer the tax credits question though sorry, I'm not eligible for them :-(

I can't help with tax credits either... Sorry but we got original birth Certs for all children on day of placement, with all bp details... We knew then already from ss paperwork, red book etc though... Sounds strange

Sorry trigger fingers it sounds strange for them to hold that back unless it's different for foster to adopt/ concurrency Because the child doesn't yet have a placement order...
It's worth questioning with ss

Thanks. It's not concurrency or foster to adopt, just normal adoption. It was same with my first adopted son though so must be our LA. I know I'll get an adoption cert once the final order is granted. I don't have a red book either but only because birth mum took it. I've spoken to someone else from HMRC and they said they don't need it under circumstances so all is ok. We have all details of birth parents from court papers so I'm not concerned about it. Just trying to sort tax credits but hopefully sorted now.

We got copies of Sqk's birth certificate from the local registry office (as placed within authority) but you can get copies of any birth certificate from the General register office (in England /Wales - see here) - except those for children who have been adopted. Had to get copies as we misplaced those given to us when he was placed and needed it for adoption order application.

cant help with the tax credits but the red book you can get replaced via your health visitor, I've had this with a couple of foster bubs. the information re immunisations and health checks etc should all be on the 'system' so should be able to be recovered even if it takes some time. the red book is so useful for dates of jabs, i'm forever being asked for these for my AS and I have no idea (no red books back then!!).

We didn't have copies of the original birth certs either - didn't even think about it at the time. Might've used matvching cert for SAP and child benefit.
