Hackney Special Education Crisis is exploring the possibility of taking group legal action against the Secretary of State for Education regarding systemic EHCP process failings resulting from underfunding of the 2014 SEND reforms. To do this 3-4 claimants are needed from different areas of the country and different types of areas (urban/rural) in order to show that similar problems are occurring in different areas. Would also be good if was an area with obvious systemic failings e.g. particularly high levels of exclusion etc
Looking particularly (but not exclusively) at: children being forced out of mainstream as a result of unmet needs/inadequate provision; children excluded as a result of the same; systemic failure to adhere to statutory timelines;
systemic failure to provide adequate funding to meet the cost of provision;
failure to initiate EHCPs promptly etc.
Obviously the stronger the cases the better; supporting evidence, ongoing/recent and with blatant/repeat failings and groups able to demonstrate shared poor experience is not isolated. This group action will benefit all CYP with EHCPs or trying desperately to get them. If you think you can help, please get in contact.
Can any one evidence:
A) poor quality assessment missing key advice, poorly written content of advice, lack of specific advice, errors, omissions in advice that misinformed drafting
B
Rpeat pre-pops and drafts due to lack of good quality written advice to inform draft, written advice ignored, list, left out, not obtained or updated, missing advice, errors in editing and specificity. And families where LA simply did not consult parent/young person choice of school, or complete consultations before naming LA choice of school.
Any worse than usual examples highlighting common issues across an area which can be evidenced, are required.
